Case Law Update: Recent Decisions of the Irish and European Courts

On February 26th 2026 the Planning, Environment & Local Government Bar Association held a Case Law update regarding recent decisions of the Irish and European Courts. This case law focused on the volume of jurisprudence emanating from the Irish Courts has increased significantly in recent years, but perhaps none more so than in the area of planning and environmental law. In addition to the specialist Planning and Environment Court, which has three permanent judges appointed to it, cases which raises issues of planning and environmental law regularly appear in the appellate and European Courts. Against this background, it is difficult for practitioners to keep up to date with the most recent developments in the case law from both the Irish and European Courts.
This PELGBA CPD provided practitioners with an overview of some of the most recent and relevant decisions of the Irish and European Courts in the area of planning and environmental law. The result of this talk furthered knowledge about recent decisions of the Irish Courts in planning and enviromental law. Presented a better understanding of judgements from the European Court of Justice and how these judgements may impact the interpretation of EU law obligations in Irish law.
